§ 1 Scope & Provider
These Terms and Conditions apply to all contracts concluded between Marie Härtel, Occultmoon – Workshops, Berlin 12487, Germany (hereinafter "Provider") and the respective participant (hereinafter "Participant") regarding the booking of workshops – both in-person and online.
By booking a workshop, the Participant accepts these Terms and Conditions in the version valid at the time of booking. Any deviating terms of the Participant shall not be recognised unless the Provider has expressly agreed to them in writing.
§ 2 Contract Formation & Booking
Workshops are booked via the Provider's website with payment processed through Stripe. The presentation of a workshop on the website constitutes a non-binding invitation to book, not a binding offer.
The contract is concluded when the Participant completes the booking process and receives a booking confirmation by email. The booking creates an obligation to pay the stated participation fee.
The Provider reserves the right to decline a booking without stating reasons – for example, if a workshop is already fully booked. In such cases, any payment already made will be refunded promptly.
§ 3 Prices, Materials & Payment
All prices are stated as gross prices in euros (EUR). The applicable price is displayed in the booking form.
Included in the participation fee:
- Instruction by Marie Härtel for the full duration of the workshop
- Basic materials for the respective workshop topic (sewing, knitting, or chainmail), unless otherwise stated in the workshop description
- For in-person workshops: use of the premises and tools on site
- For online workshops: access to the live video stream and any provided digital materials
Not included in the price (unless otherwise stated):
- Additional materials beyond the basic supplies
- Travel to and from in-person workshops
- Personal devices and internet access for online workshops
Payment is made in advance via Stripe (credit card, SEPA direct debit, or other available methods). A workshop place is only confirmed once full payment has been received.
§ 4 Minimum Age & Requirements
Workshops are generally suitable for participants aged 16 and above. Participants under the age of 18 require written consent from a parent or legal guardian, which must be submitted before the start of the workshop.
For chainmail workshops, which involve working with sharp-edged tools, the minimum age is 16 years. The Provider may grant exceptions in justified individual cases.
Prior experience is generally not required unless otherwise stated in the workshop description. Participants with health conditions that may affect their participation are asked to inform the Provider in advance.
§ 5 Cancellation by Participants
Cancellations must be submitted in writing (email) to info@occultmoon.de. The date on which the cancellation is received by the Provider shall be decisive.
| Time before workshop start | Cancellation fee |
|---|---|
| More than 28 days | No fee – full refund |
| 15 – 28 days | 50% of the participation fee |
| 8 – 14 days | 75% of the participation fee |
| Less than 8 days / no-show | 100% of the participation fee |
Transferring a booked place to another person is always free of charge; the Provider must be notified by email in advance. Any refund due will be processed within 14 business days via the original payment method (Stripe).
§ 6 Cancellation or Changes by the Provider
The Provider reserves the right to cancel or reschedule a workshop if:
- the minimum number of participants (generally 3 persons) is not reached,
- the Provider is ill or another important reason arises,
- force majeure (e.g. official orders, closure of the venue) prevents the event from taking place.
In the event of cancellation by the Provider, all fees already paid will be fully refunded. No further claims for compensation – in particular for travel or accommodation costs – shall apply.
If the workshop is rescheduled or moved to an online format, Participants may choose between attending the alternative date and receiving a full refund.
§ 7 Right of Withdrawal
Consumers within the meaning of § 13 of the German Civil Code (BGB) have the right to withdraw from this contract within 14 days without stating any reason. The withdrawal period begins on the day the contract is concluded (booking confirmation).
The withdrawal must be declared in writing or via email to:
Marie Härtel · Occultmoon – Workshops · info@occultmoon.de
§ 8 Liability & Safety
The Provider shall be fully liable for damages caused by intentional or grossly negligent conduct, as well as for damages resulting from injury to life, body, or health.
Beyond this, the Provider's liability for slightly negligent damage to property or financial loss is excluded to the extent permitted by law.
Special notice for craft workshops (in particular chainmail): Working with tools, needles, wire, and metal rings carries an increased risk of injury. Participants are obliged to follow the Provider's safety instructions and handle materials with care. The Provider accepts no liability for accidents arising from failure to follow safety instructions or from grossly negligent behaviour on the part of Participants.
The Provider accepts no liability for personal belongings or valuables brought to workshops by Participants.
§ 9 Copyright & Intellectual Property
All workshop materials, instructions, patterns, and resources are protected by copyright. Participants may use them exclusively for personal, non-commercial purposes. Any sharing, reproduction, or commercial use requires the Provider's prior written consent.
Photo or video recordings of other Participants require their explicit consent. Recordings featuring the Provider or other individuals may not be published without permission.
§ 10 Online Workshops – Special Provisions
For online workshops, Participants are responsible for ensuring a stable internet connection and suitable technical equipment (computer, tablet, or smartphone with camera and microphone). Technical failures on the Participant's side do not entitle them to a refund.
Access details for the online workshop will be sent by email no later than 24 hours before the start. Recording of the live stream by Participants is not permitted without the Provider's explicit consent.
§ 11 Data Protection
Personal data of Participants is collected, processed, and used solely for the purpose of fulfilling the contractual relationship, in accordance with the General Data Protection Regulation (GDPR). For further details, please refer to the Privacy Policy on the Provider's website.
Payment data is processed exclusively through the payment service provider Stripe, Inc. The Provider does not store complete payment data.
§ 12 Amendments to These Terms
The Provider reserves the right to amend these Terms and Conditions for valid reasons (e.g. changes in law or new offerings). Significant changes will be communicated to Participants with existing bookings by email. The version valid at the time of booking shall always apply.
§ 13 Final Provisions
These Terms and Conditions are governed by German law. The place of jurisdiction, to the extent permitted by law, is Berlin, Germany.
Should any individual provision of these Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. Any invalid provision shall be replaced by the applicable statutory regulation.
